Healthcare Giant Handing $46,000,000 To Members After Being Accused of Disclosing Private Data to Google, Microsoft and Other Third Parties

A health insurance firm has agreed to pay millions of dollars to settle a class action lawsuit that accused it of sharing sensitive and confidential information with third parties.

According to the settlement administrator’s portal, Kaiser Foundation Health Plan, Inc. will pay $46 million to compensate Kaiser Permanente members whose data was allegedly impacted.

Kaiser Foundation Health Plan, Inc. is the nonprofit health insurance arm of Kaiser Permanente, an integrated healthcare consortium.

The class action lawsuit, which was filed in June of 2024, alleged that Kaiser Foundation Health Plan, Inc. installed code on its websites and mobile apps that allowed third parties to intercept data that included “patient status, identifying information, medical topics researched, choices made” as well as the information patients shared with their medical providers in their communication.

The third parties that Kaiser Foundation Health Plan, Inc. is accused of sharing the settlement class members’ private and confidential data with include Google, Microsoft, Adobe and digital analytics platform Quantum Metric.

Victims of the data breach, specifically Kaiser Permanente members in California, Colorado, the District of Columbia, Georgia, Hawaii, Maryland, Oregon, Virginia or Washington who used the integrated healthcare consortium’s websites or apps from November 2017 to May 2024, are eligible to receive between $20 and $40 from the settlement.

The named plaintiffs in the class action lawsuit are also eligible to receive service awards of up to $5,000.

Claims must be submitted by March 12th of 2026. The final approval hearing will be held on May 7th of 2026.

Although the company has agreed to the settlement, Kaiser Foundation Health Plan, Inc. denies any wrongdoing.
